Terms & Conditions of Service

Last Updated: May 25, 2026

1. Nature of the Platform and Services

The Company operates exclusively as a decentralized online booking marketplace and introductory portal designed to connect international tourists and guests with certified, independent local excursions and transportation operators in Saint Lucia.

  • No Employment Relationship: The Company is not a transport operator, a taxi company, or a tour provider. The drivers and guides paired with guests are strictly independent contractors. They are not employees, joint ventures, or agents of The Company. When you secure a booking, you are entering into a direct legal agreement with the specific provider allocated to your itinerary.
  • Driver and Vehicle Standards: For the safety and reassurance of our customers, The Company strictly maintains a closed network of operators. We guarantee that guests will only be paired with independent taxi drivers who are:
    • Officially certified and registered with the appropriate Saint Lucian transport boards, tourism authorities, and recognized taxi associations.
    • Fully covered by valid, comprehensive commercial liability insurance specifically rated and legally certified for the commercial transport of foreign nationals on-island.

2. Booking & Advance Deposit Policy

To secure a customized itinerary, tour slot, or dedicated private airport transfer through The Company, customers are required to satisfy advance financial obligations in accordance with the platform's tier structures:

  • Advance Deposit Requirement: All online reservations require a mandatory advance deposit to finalize the booking. This deposit guarantees vehicle availability, secures localized tour access, and locks in listed rates against seasonal fluctuations. The explicit deposit amount is calculated and visible at checkout.
  • Balance Payments: Unless explicitly stated otherwise during checkout, any outstanding balance remaining after the online deposit must be settled directly with the assigned independent driver or operator upon arrival, or via our integrated mobile payment architecture prior to the commencement of service.
  • Currency and Processing:All financial transactions processed natively through The Company are handled in United States Dollars (USD), unless specified otherwise. Any additional currency conversions or foreign transaction fees are determined entirely by the user's banking institution.

3. Cancellation and Refund Policy

The Company implements a transparent cancellation matrix designed to balance flexibility for international travellers with financial security for local independent operators who reserve exclusive blocks of time for scheduled guests.

3.1 Guest-Initiated Cancellations

  • Cancellations 48 Hours or More Prior: If a booking is cancelled by the guest 48 hours or more before the scheduled commencement time, the advance deposit will be fully refunded, minus a minor standardized administrative processing fee.
  • Cancellations Within 48 Hours: If a booking is cancelled by the guest within 48 hours of the scheduled pickup or tour start time, the advance deposit becomes entirely non-refundable. This protects independent operators who have passed up other commercial bookings to hold the slot.
  • No-Shows:Failure to arrive at the designated pickup location within thirty (30) minutes of the agreed time without explicit communication will be classified as a “No-Show.” No-shows result in the forfeiture of the complete deposit, and the independent driver will be released from service.

3.2 Platform or Environmental Cancellations

  • Cruise Ship Schedule Changes: For guests arriving via cruise line, if your vessel alters its itinerary or is completely unable to dock at Port Castries or Soufrière due to marine weather conditions, a full refund of the deposit will be issued upon provision of official itinerary adjustment verification.
  • Force Majeure & Extreme Weather: In instances of severe tropical systems, acts of God, infrastructure failures, or government-mandated shutdowns in Saint Lucia, The Company or its assigned operators reserve the right to cancel bookings for customer safety. In such scenarios, guests will be offered an alternative date or an immediate 100% refund of the deposit.

4. Fraud Prevention and Transaction Security

The Company maintains a zero-tolerance policy towards fraudulent transactions, unauthorized credit card use, and booking manipulation. We implement strict safeguards to maintain ecosystem integrity:

  • Verification Checks: To mitigate card-not-present (CNP) fraud, The Company reserves the right to run verification algorithms on all payments. Guests may be asked to present a valid photo identification (such as a passport) and the physical or digital card used for verification to their driver prior to boarding.
  • Chargebacks: Unjustified or fraudulent chargebacks initiated by consumers will be contested vigorously. The Company logs digital footprints, device footprints, IP geolocation data, and signed driver confirmation receipts to verify service delivery. Any user executing a fraudulent chargeback will be permanently barred from the platform.

5. Privacy Policy & Data Protection

Your privacy is central to our platform's operations. This section outlines how your operational data is compiled, stored, and systematically shared to execute your transfers.

5.1 Information We Collect

We collect essential operational metrics required to deliver seamless island logistics, including full name, nationality, email address, phone number (with WhatsApp connectivity for on-island communication), flight or cruise ship information, hotel/villa location data, and processing details via secure tokenized channels.

5.2 Data Minimization & Sharing

The Company respects the confidentiality of its users. Your personal information is exclusively shared under strict data minimization guidelines:

  • Operational Sharing: Your name, phone number, and pickup logistics are shared strictly with the assigned independent, certified driver for the sole purpose of coordinating your specific on-island transport. Drivers are bound by strict non-disclosure conditions and cannot use your data for external marketing purposes.
  • No Third-Party Sales: The Company will never sell, lease, trade, or distribute your personal details to external marketing agencies or third parties for advertising purposes.

5.3 Security and Tokenization

All sensitive financial processing is executed via encrypted, PCI-DSS compliant gateways. The Company does not retain, view, or store raw credit card numbers on its native database architectures.

6. Limitation of Liability

Because The Company operates solely as an intermediary matching service, the platform, its officers, and directors hereby disclaim any and all liability for personal injury, property damage, delays, financial loss, or unexpected route variations resulting from the actions, omissions, or negligence of independent third-party operators.

All claims regarding transport incidents, transit delays, or tour execution must be directed exclusively to the respective insurance policies or legal entities of the certified independent operator handling the itinerary.

7. Governing Law

These Terms & Conditions, operational policies, and platform interactions are governed exclusively by and interpreted according to the laws of Saint Lucia. Any legal dispute, claim, or arbitration arising from the use of this portal shall fall under the jurisdiction of the courts of Saint Lucia.
